These terms apply when you use the WeldCo website, the Tradestore ordering platform, or the SafeWeld app, each operated by WeldCo Solutions Pty Ltd ("WeldCo", "we", "us"). By using them, you agree to these terms.
Accounts and access
Tradestore and SafeWeld are provided to authorised business users. Accounts are issued by us and are personal to you. You must not share your account or let anyone else use it, and you must tell us promptly if you believe your account has been used without your authorisation.
We sign you in using a one-time code sent to your registered email address or mobile number. Keep those contact details current, and keep access to them secure.
We may suspend or withdraw access to an account at any time, including where an account is no longer required or where these terms have been breached.
Using our platforms
You agree not to:
- use the platforms for any unlawful purpose;
- attempt to gain unauthorised access to any part of the platforms or to another user's account or data;
- interfere with, disrupt or place unreasonable load on the platforms or the systems behind them;
- copy, extract or reuse content or data from the platforms other than for your own business dealings with us; or
- upload anything unlawful, misleading, or that infringes someone else's rights.
Assessment records
Safety assessments created in SafeWeld are business records. You are responsible for ensuring the information you record is accurate and complete at the time you submit it. Where an assessment needs to be corrected, use the amendment function so the record and its history remain intact.
SafeWeld supports the recording of assessments. It does not replace your own obligations under work health and safety laws, or the professional judgement of the person carrying out the assessment.
Quotes, orders and pricing
Prices, stock availability and product information shown online are indicative and may change. A quote is not an offer capable of acceptance unless we say so, and an order is only accepted once we confirm it. Where we have a separate supply agreement or trading terms with your business, those terms govern the supply of goods and services and prevail over these terms to the extent of any inconsistency.
Intellectual property
The platforms, their content, and the software behind them remain our property or that of our licensors. Nothing in these terms transfers any intellectual property rights to you. Product names, brands and logos belonging to our suppliers remain the property of their respective owners.
The records and data you enter remain yours or your employer's, as applicable. You grant us the right to host, process and retain that information so we can provide the service and meet our record-keeping obligations.
Availability
We aim to keep the platforms available, but we do not guarantee uninterrupted access. We may suspend access for maintenance, upgrades, or where necessary to protect the security or integrity of our systems.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of data, or loss arising from your reliance on information in the platforms, and our liability is limited to resupplying the relevant service or paying the cost of having it resupplied.
Privacy
Our handling of personal information is described in our Privacy Policy.
Changes
We may update these terms from time to time. The current version will always be available on this page, with the date it was last updated shown at the top. Continuing to use the platforms after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
